SUBJECT
The subject of this Sales Contract Pre-Information Form is the sale and delivery of the product/products with the qualities and sales price specified below by the SELLER to the ORDERING/BUYER, in accordance with the provisions of the Law on Consumer Protection No. 6502 – Distance Contracts Regulation (Official Gazette: 27.11.2014/29188). By accepting this pre-information form, the BUYER acknowledges that, upon confirmation of the contract subject order, they will be obligated to pay the order amount, shipping fee if any, taxes, and other specified additional costs and that they have been informed about this in advance.

GENERAL PROVISIONS
5.1. The BUYER acknowledges, declares, and undertakes that they have been informed about the basic characteristics of the product subject to the contract, the sales price, payment method, and delivery details, as well as the pre-information on the website, and that they have provided the necessary confirmation electronically before the establishment of the distance sales contract.
5.2. Depending on the distance of the BUYER’s place of residence or the person and/or institution indicated by the BUYER at the specified address, the product subject to the contract is delivered.
5.3. The SELLER undertakes to deliver the product subject to the contract in accordance with the specifications specified in the order, free from any defects, in compliance with legal requirements, standards, and the necessary information and documents required for the job, with integrity and in accordance with the principles of honesty, with care and diligence during the performance of the work, and to maintain and improve the quality of the service. The SELLER also undertakes to act with caution and foresight.
5.4. In the event that the SELLER is unable to fulfill its obligations under the contract due to force majeure circumstances, which are beyond the control of the parties and which could not have been foreseen previously, and which prevent or delay the fulfillment of the obligations of the parties, the SELLER agrees to notify the BUYER within 3 days from the date of learning of this situation and to refund the total amount to the BUYER within 14 days. The BUYER also has the right to request the cancellation of the order, replacement of the product subject to the contract with an equivalent product if available, or postponement of the delivery period until the obstructive situation is eliminated. In the event of the cancellation of the order by the BUYER, the product amount will be refunded to the BUYER in cash within 14 days. In the case of payments made by the BUYER with a credit card, the product amount will be refunded to the relevant bank within 14 days after the cancellation of the order by the BUYER. The BUYER acknowledges that the time it takes for the refunded amount to be reflected in their account is entirely related to the bank’s processing period, and the BUYER agrees not to hold the SELLER responsible for any possible delays.

RIGHT OF WITHDRAWAL
In accordance with Article 15 of the Distance Sales Regulation, the right of withdrawal may not be exercised in some cases. In this context, in contracts for the delivery of goods that are opened after delivery and are not suitable for return for reasons of health and hygiene, the right of withdrawal cannot be exercised by the BUYER as a consumer.
LEGAL REMEDIES OF THE BUYER AND THE COMPETENT JUDICIAL AUTHORITY
In disputes arising from this contract, Turkish Law shall apply. In this context, within the framework of the limits determined and announced annually by the Ministry of Commerce, the BUYER may apply to the Provincial and District Consumer Arbitration Committees and Consumer Courts for disputes that fall within these limits. Within this framework, the BUYER may apply to the Istanbul Anadolu Arbitration Committees and Istanbul Anadolu Consumer Courts.
